- Public input- A spokesman from the Brooklyn Masonic Lodge addressed
the board concerning the possibility of having a Masonic cornerstone in
the new construction.
- Approved Student Uniform Review Committee Charge
without ever stating what the charge is.
- Architects/Construction Manager Reports: board was shown the latest
drawings for the proposed 800-seat auditorium.
- Curriculum Update: 3 new academic clubs exist at FHS: science, history,
& medical technology.
Seven students passed the A+ computer training test part1, one student
(Preston Petty) passed part 2 & is A+ certified.

- Passed Ordinance #1066 RE: PD "Brookville Estates" at FM740 "T".
- Passed Ordinance #1067 amended to require property owners to keep
non-tree ground cover within 100 ft. of public or private roadway
paving or curbing to max. height of 12 inches.
- Public hearing #1 for 196 acres on FM1641 (Alexander tract). No

- City Manager- Thursday P&Z meeting @ 6PM. Christmas decorations
are now completely installed.

- Sewer project just started on Trinity St. will be completed

- Drive friendly during the holiday season, but DWI laws
will be strictly enforced!

keep a watch on your residence.
- Home & Auto burglaries were down last month, 20 fire & medical
calls were made.
- Public hearing #2 for 196 acres on FM1641 (Alexander tract). No
citizens spoke.
- Accept dedication of improvements from McKellar Place Ph. 6, and
authorize staff to draw up final platt.
- Accept loan bid from City Bank for financing of dump truck for up
to $35,000 at 3.0%.
- Council Communications- All members congratulated the Eagle Scouts,
thanked Intex for help with decorations, and wished the Football team
luck for the playoffs. The Mayor also mentioned the FPHL Candlelight
Tour of Homes.
- 2002-11-25 City Council / P&Z Workshop
- Representatives from Texas Land Advisors presented a concept
plan for developing 662 acres between Antiqe Row, Windmill Farms
and FM 548. Over 100 acres are set aside
to be donated to the city for a golf course, which the city
would build and maintain. The development would be a
combination Public Improvement District (PID) / Fresh Water
Supply District (FWSD). As the PID lies within the Forney ETJ,
the City would have to approve it's creation, while the County
Commissioners would have to approve the FWSD. Bonds sold for
development would affect only property within the PID.
City officials felt having larger lot
sizes was more important than a future golf course, and suggested
the developer review the Comprehensive Plan and schedule further
workshops with the P&Z.

- Presented Team of Eight Training Certificates to Board Members - awarded
for attendance of Team-Building meeting.

- Canvass Election Results - 941 for, 338 against.
- Purchase of School Buses - will acquire 1 53-passenger and 6 77-passenger buses,
purchasing as much as current budget will allow, and finance the remainder.
The City of Forney is applying for a grant to provide a
sidewalk along the west side of FM740 up to Criswell - if this grant is not approved,
Superintendent Smith feels the FISD should consider pay for the sidewalk. Once the
sidewalk exists, no students would be bussed to Criswell.
Superintendent Smith stated in negotiation with developers
of 2 new subdivisions regarding land for new elementary schools, the developers have
been told no students will be bussed to those campuses.
- Reappointments to the Ellen Brooks West Memorial Library Board - Carol Foster,
Judy Griffin.
- Architects/Construction Manager Report - Auditorium Plans - the architect
presented 3 plans. Superintendent Smith
stated the FISD is accepting bids on 1 and 2 new elementary schools, and when
the bids come in, the demographics should be available to decide how many to build.
- Principles of Determining Attendance Zones - Superintendent Smith presented
6 principles used: Optimized size, stability, heterogeneously grouped, proximity
to campus, program uniformity, and school district unity. All principles are
equally weighted.
- Consider Contract for Demographic Services and Student Projections - after
a Very lengthy discussion, accepted a proposal from School District Strategies
for a ten-year projection with quarterly updates. Cost is $29,000 per year.
Other proposals costing $26,500 and $13,000 were rejected, as the update period
and data collection, resp., were not equivalent.
- Available Seating Report and Professional Personnel Needs- Two teachers will
be hired, K & 4th, and when they start next semester, there will be no available
elementary classrooms left in the district. As of Nov. 6 the district had
3,367 students. Johnson is averaging 7 new students per week just from
Windmill Farms. District is 55 students short of a 30% growth rate in the
elementary schools for this school year.

a teacher to fill an open position caused by resignation at Criswell.
- 2002-10-21 FISD board
- Present Certificate to Preston Petty recognizing him as a National Merit
Scholarship Semi-Finalist.
- TEA 2002 Gold Performance Acknowledgments presented to all Campus Principals
- Present TAAS Campus Performance Certificates to Campuses
- Introduce Russian Exchange student Natash Takmakoua.
- 2002-2003 Textbook Selection Committee - approved members as recommended
by administration. Books to be considered are Social Studies, Economics, and Pre-K.
- Architects/Construction Manager Report(s)
- Major break-in last weekend at Henderson, most of contractors tools were stolen.
- Light poles are ready to be installed when the ground dries out...
- Stadium Proposal - approved increasing number of seats by 1,430 @ $140.42
each (total $180,559.90), for a total of 4,600 home and 1,700 visitor seats.
- Approved Change of Bad Weather Holiday on May 30th - DEIC requested this day be
deleted and teacher workday on Sat. May 31 be moved to May 30.
- TASA/TASB Convention - one suggestion acquired was that teachers be required
to call their principal when calling in sick. Also, the board should get a weekly
teacher absentee report.
- Took no action on: Policy DG (Legal) - Employee Rights and Privileges,
Policy DEB (Local) - Compensation & Benefits: Fringe Benefits, and
Recommended Policy DPB (Local) - Substitute, Temporary, and Part-Time
Positions - Informal policy is a substitute must work 10 days every 6 weeks
for free tuition for their child, but this isn't strictly enforced. Administration
felt welfare of the children was more important, and wouldn't require students
to leave the district. The district currently has 125 substitute teachers. This
issue will be revisited about next March.
- Took no action on DEE (Local) - Compensation and Benefits - Expense Reimbursement.
- Approved a new Policy CI (Local) - Disposal of Surplus Property - this allows
the administration to sell district personal property valued at less than $5,000,
to take bids for items less than $10,000. For assets valued over $10,000, bids
must be taken and presented to the board for approval.
- Current and Delinquent Taxes
- Area Tax Rate - Forney was seventh from cheapest among the 25 selected districts
listed.
- Unaudited Fund Balance is approx. $1,000,221.
- After a 30 minute Executive Session -
hired personnel as recommended by the administration.
- Carol Foster - Title Reading Teacher
- Set November and December Board Meetings, and discussed having board members
available at "bond informational meetings" at the temporary early voting locations.
- 2002-10-15 City Council
- Adopted ord. 1061 setting min Senior Citizen rate at $6.53 / month,
and relating sewer usage to 3-month winter average volume.
- Public Hearing on zoning request from SFR6 to Duplex - only the applicant,
Robbie Powers, spoke.
- City Manger-
- City Fall Cleanup Nov. 2 about 9-12 AM at Jackrabbit Stadium.
- Monday 21 at 1:00 PM City of Mesquite holding hearings re: annexing
land south of Forney.
- Public Works-
- Improvements continue, have recently laid 85 yard of concrete and
150 tons of asphalt patching.
- Responding to council questions, stated one resident has signed up for
the sidewalk replacement program, and others are considering it.
- Possibly by the end of Nov., all water meters S. of Hwy 80 will be
fitted for electronic readings.
- Zoning change: SFR6 to Duplex, 7812 sq. ft. at 905 E. Buffalo - referred
back to P&Z for reconsideration.
- Approved conditional use request for used car lot for No Limit Motors
on E. Hwy 80 for one year.
- Approved conditional use request for FISD temporary portable classrooms
until 2 weeks after end of school.
- Tabled prelim. & final plats for 4.4 acres at
800 E. Hwy. 80 for H&P Enterprise.
- Prelim. plat for 102 acres on FM548 1/2 mi. N. of Hwy. 80 for
George Martin:rep. Phil Able addressed the council & debated the ability
to widen a green area behind four lots.
Council approved subject to comments by engineering staff and parks board,
allowing a maximum of 10% variance on lot dimensions
of the four lots in question.
- Prelim. plat for 196 acres at SW FM1641 between UP RR & Nicole,
known as Fox Hollow, for Bill Rogers: developer agreed to adjust park area,
remove four-way intersections, and increase curvilinear streets, but felt
the $750,000 roadway impact fee for FM1641 frontage was an unfair burden,
considering most of the traffic there serves non-Forney residents, and
citing a Carter-Burgess traffic study showing the development would not
change the categorization of the road. The development is already absorbing
about $1,100,000 for a collector street and part of the FM548 extension.
Council approved this plat, by a 3-2 vote,
subject to comments by engineering staff and parks board, and reducing
the impact fee to a maximum of $150,000 (est. 20% of the total)
- Approve prelim. plat for 47 acres at Hwy 80 & Lovers Lane, known as
Skyline Estates Ph. II, subject to memorandums & Park Board.
- Approved final plat for Mustang Creek Ph. II for 56 acres John Gregg survey
abs #171, at end of Bowie St., for Hillwood RLD.
- Award bid for 2003 Crown Victoria to Ford Country Lewisville for $20,350.
- Award financing for 2003 Crown Victoria for 2 years at 3.42%
- Public Communications: Mac McCuistion addressed the council concerning
comments made at the last council meeting regarding burning of brush within
the city limits.
- Council Communications: members expressed appreciation to P&Z, park board,
and other committee members for their time and effort. Cates stated the
parade was a success, although it ran a little fast at times.
- 2002-10-07 FISD board
- Gene Albright addressed the board, stating his belief that only
students of full-time substitute teachers should be allowed to attend
Forney schools, and that currently about 25 students attend FISD that
shouldn't. He presented the board with a written proposed policy
regarding the matter.
- Approve Extended Sick Leave Request(s)
- Architects/Construction Manager Report - the new stadium grass & track
asphalt are in place, track coating to be applied early spring. The field
lighting should arrive end of next week, structure for the press box arrives
near end of next month. Henderson campus- hope to have it dried in by early
October.
- Accepted bid of approx. $28,300 for building a conference room and storage at Johnson Elementary.
- Took no action on Stadium Proposal- considering 2 plans to expand the number
of seats on the home-side bleachers. Current plans call for about 3,500 seats,
plans are to add either 1,188 or 1,430 seats.
- Consideration and Selection of Legal Counsel - selected Walsh, Anderson, Brown,
Shulze & Aldrige as new counsel.
- Consider Participation in Lake Ray Hubbard Shared Services Arrangement - moved
to not participate in this program, starting next year.
- Took no action on: Consider Interlocal Agreement with MCA Development, LPT
re: sewer services to Henderson Elementary
- Approved Interagency Agreement with Kaufman County Sheriff's Department for
School Resource Officers - under this agreement, the Sheriff's Dept. will provide
2 officers who will work for, but not be employees of, FISD. FISD will provide
the vehicles, the KSO will provide uniforms, training, & equipment for the officers.
Since the resignation of Constable Bobby Watts several weeks ago, the FISD has had
no School Resource Officers on staff.
- 2002-10-05 Grand Opening of the relocated Ellen Brooks West Memorial Library
at the new FHS (on FM741).

- Adopted year 2000 International building, mechanical, plumbing, fire,
and one and two family dwelling codes. Adopted 2000 International Engergy
code, which is required by TX SB 5, and will have some impact on lighting
and heating/cooling for new construction. Adopted 1999 National Electrical code.
- Approved a resolution authorizing City staff to apply for a NCTCOG grant
for solid waste project.
- City Manager-
- as of Sept. 17, 4292 planned lots were on the books. This will likely
raise the city population to approx 18,000 in two years.
- Capital Improvement Committee will meet on Oct. 10 to consider the
water & impact fees.
- TX SB 5 mandates a 5% reduction in energy usage for certain areas,
Kaufman County is included.
- American Red Cross is looking for community representatives.
- City Fall Cleanup will occur Sat. Nov. 2 at Jackrabbit Stadium (old
FHS, new FMS) parking lot, 10AM.
- Police Chief-
- Oct. 12 homecoming parade - will try one more year to close FM740
long enough to have the parade.
- Several police and fire personnel will attend training in NM for
incident response training, explosives identification, terrorist
techniques. Funding is provided by DOJ grant.
- In response to council questions about controlled brush fires in
city limits, stated approval can be granted, but are allowed only when
weather conditions are appropriate.
- Approved final plat for 61 acres of Deerfield Heights @ NE corner of
Ridgecrest & CR223 (Ranch Rd).
- Appointed David Yandell to P&Z board, replacing John Hurvey who resigned.
- Awarded bids to Randall Noe for a Ford Ranger pickup for $16,498 and
an automatic dump truck for $30,660.
- Public Communications- Forney Historic Preservation League vice-chairman
spoke in favor of the city accepting the property bequeathed by the late

- Mayor Bowen reported hearings will be held to review the new budget,
which will provide for additional city personnel, police & fire employees,

- Stated the city tax rate will increase from
0.5008 to 0.5200 which, being below the effective rate, will not require
any public hearings to be adopted.
- The sewage rate, which is calculated
based on 3 winter months water usage, will go up 15 cents.
- Currently 3619 lots are zoned for residential construction, spread
across about 7 subdivisions.
- A public hearing for the proposed budget will be held Sept. 3, 2002.
- Police Chief Barnes -
- The school zone speed limits will be strictly enforced. There have
been traffic problems this week, especially around the Johnson campus.
- Thanked the Presbytarian Church Ladies for all the baked goods they
have been providing to the police & fire dept's.
- Councilman Grooms asked if it was possible to determine the median
value of homes currently being permitted for construction. The permit
value only indicates the construction cost.
- Councilman Woods asked if TxDOT would be willing to take care of
some erosion along some roads, such as Pinson, before the road is upgraded.
- Council authorized City Manager to accept a payment from Oncor Energy
in the amount of $10,465 which would have been Forney's pro-rata share of
a lawsuit filed by the city of Denton against Oncor about 2 years ago if
Forney had joined 37 other cities in the lawsuit. Marshall Park from Oncor
explained the arrangement.

- Cates stated he was not in favor of having combined Council and P&Z
meetings, that the current process works quite well.
- Hatley agreed, and thanked the Avon Breast Cancer Walk participants who were
present for helping to promote awareness.
- Grooms also congratulated the Walk participants. He feels having combined
council and P&Z meetings would be useful.
- Mayor Bowen stated he believes relying on the generous volunteers who
make up committees such as the P&Z is appropriate, and having combined meetings
could imply a lack of confidence in the committees. And any council member
who wishes to attend P&Z or any other committee meeting is free to do so.
- Mayor Bowen read a proclamation in honor of the participants of the Avon
Breast Cancer Walk: Jill Beam, Connie Ingersoll, Nancy Canard, Connie Rush,

Plan. Dan Sefco and Eddie Haas gave presentations regarding the
proposed plans. There were no public comments. Expected cost for
roadway improvements is $14.7 million, assuming TxDOT pays for 1/2
of state portion. Vehicular miles are predicted to expand to 5,900
over the next 10 years, this roadway plan will provide for 7,000.
- Approve the Capital Improvements Plan, and the Land Use Assumptions,
and set July 23rd as tentative public hearing date for the Roadway
Impact Fee Ordinance.
- City Manager - urged citizens to remain disciplined in use of
water for landscaping purposes - even though the city is currently
blessed with adequate water supplies, water should be used prudently.
- Public Works - standing water is a problem, because of mosquitos,
and the city is using a new kind of briquette that kill the larvae.
Jim McConnell suggested citizens should spray
insecticide around landscaping, in the dark areas mosquitos inhabit.

- Disaggregation of Student TAAS Data - Mick Anderson reported the preliminary TAAS
Exit Exam scores for this year's Sophomores: 95% math, 96% writing, and 97% reading.
Tommy Riggs explained the TLI (Texas Learning Indicator) which is a weighting applied
to the actual TAAS scores to determine the score required to pass. For example,
this year a passing score on the 10th grade TAAS math section was 48%, which is
adjusted by the weighting to a TLI of 70.
This 10th grade test is at an 8th grade-level. In two years, the 10th grade TAAS
exit exam will be replaced by an 11th grade-level TAAKS Exit Exam.
Approximately 6-7% of the district students are
exempted from taking the TAAS.

- Police Dept: a house fire was determined to be caused by arson, and arrests

- Under consent items, approved creation of Municipal Utility District #1,
covering part of the area E. of 460 & N. of Hwy 80.
- Held public hearings on 4 zoning/conditional-use items. Only the
applicants spoke.
- City Manager:
- Read a letter from NRG Energy, indicating the second power
plant would be constructed "when the time is right".
- Mentioned that citizens should be cautious now that electrical
power deregulation has started.
- Expects new owners of land involved in right-of-way acquisition to
respond in about 7 days.
- Police Chief:
- Fire Dept. has retired the 1987 Suburban for a new Ford Excursion. Funds
came from Kaufman County.
- Arrested 3 alleged to be involved in repeated burglaries of local mobile-home
manufacturers.
- On March 5, a dog "darted" by Animal Control died- he apologized to Mr. & Mrs.
Black for their loss. The department is now conducting a review of their policies.
Since Sep. 2000 the city has impounded 675 animals, only 18 of those were
"darted", 16 of those were recovered in good condition.
- Public Works: water line changes are complete, cleanup now being done.
- Tabled a zoning change from Ag. to P.D. for 53 + 189 acres on FM 741 after
discussing minimum and average lot sizes.

- Public Communications-
- Candy Black- spoke concerning the death of her dog "Buddy" from the
"darting" procedure. She feels City staff and personnel did not handle
the situation with proper respect or haste, and her dog might have lived had
it been taken to the veterinarian sooner.
The Mayor apologized for the situation, & stated that a
review of the darting policy was under way. He also pointed out that loose
animals, even pets, have a high chance of biting someone.
- Pamela Dildae- spoke concerning the darting of her pet dog in Forney during
2000, showing pictures of the dog and Xray images of its injuries - a hip was
broken, requiring $2,500 of surgery. She also criticized city personnel for
not having an appropriate attitude.
- Pamela Fogle- asked if "darting" was the first, second, or last resort.
The Mayor replied it was the last resort. Ms. Fogle also asked who on
city staff had the compassion to deal with pet owners, and if council member
had authority to have animals released from the pound.
- Marc Schreiber- spoke regarding what he feels is selective enforcement
of the sign ordinance regarding garage sale signs on street right-of-way.
He feels citizens don't have enough notice when ordinances are changed,
and suggested such changes could be noted on a utility bill, so that the
city wouldn't incur any costs to provide notification.

investigation is under way.

- Sandra Taylor, FYA Soccer Dir. spoke of a need for more soccer fields,
stating the number of kids playing has doubled in 2 years to over 500 kids. She
expects to have 600-700 by fall.
- Randy Mann, FYA Pres. voiced his concerns that the city parks are not sufficient
to keep up with current demand.
- Sam Cochran, FYA VP, also addressed lack of park space and athletic fields,
and stressed the importance of keeping youngsters occupied with organized activities.
- Council members replied that the parks board is in the process of hiring
consultants to help plan the growth of city parks and amenities, and the cost
of providing same will prohibit any immediate relief, but it is already being planned.

- Public Input:

addressed the desire for FISD Soccer program. Well in excess of 50
visitors attended the meeting regarding this issue.
- FHS Senior Catherine Atkins spoke concerning problems with the FHS
basketball team.

- Future UIL Soccer Participation - took no action. The Superintendent stated
the first priority was to add more coaches for sports we already have. The second
priority would be to add new sports, and recommended against adding soccer next year.
The board requested the administration to do a cost projection analysis, and a plan
to implement a soccer program at some future date.

- After a 2 hour executive session, moved to extend certain employee contracts
for one year as recommended by the administration.
- 2002-02-11 Captital Improvements Advisory Committee
Heard a presentation from Sefco representatives, and from Parson's
Transportation Group, regarding assessment of roadway impact fees. Such
fees would be applied only to new construction, due when the permit is
issued. The cmte. agreed on assuming the State of Texas would contribute
50% of the cost of upgrading state roads in the area in setting the impact fee rates.
